Terms of Service

1. Acceptance of Terms

By accessing or using CertFile (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service. The Service acts as a digital intermediary for structural compliance mapping, automation, and technical data collection.

2. User Responsibilities & Liability

CertFile exists to streamline compliance documentation, but the ultimate responsibility for structural integrity, material safety, and accurate data input lies entirely with the Installer, Contractor, or Administrator executing the project.

  • Accuracy: Users agree to provide truthful and precise measurements, photographic evidence, and parameters.
  • Indemnification: CertFile assumes zero liability for faulty construction, material failures, or physical damages resulting from user error or incorrect software utilization.
  • Legal Force: Digital signatures executed via our platform carry the weight of legal intent. Do not sign documents unless fully prepared to warrant the technical specifications described therein.

3. Enterprise Subscription & Billing

Certain components of CertFile are subject to payment or subscription models (via Stripe). If applicable, you agree to provide current, complete, and accurate purchase and account information for all purchases made via the platform. You further agree to promptly update account and payment information, so that we can complete your transactions and contact you as needed.

  • Subscriptions auto-renew unless explicitly terminated prior to the billing date.
  • CertFile reserves the right to suspend platform access resulting from non-payment.

4. System Administrators & Auditing

When utilizing CertFile for a specific Installation System (e.g., Baumit), you explicitly authorize the respective System Administrator to securely access, audit, review, and approve the technical data generated by your workspace prior to issuing finalized System Warranties.

5. Intellectual Property

All source code, software architecture, UI design, generative algorithms, and database structures belong exclusively to CertFile and its developers. You may not reverse-engineer, deploy localized instances, or derive competing software from our underlying IP.

6. Service Modifications & Uptime

While we strive for a 99.9% uptime, CertFile reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable for any modification, or suspension resulting from acts of God, cloud-provider outages, or structural changes.

7. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Ireland, without regard to its conflict of law provisions. Any disputes shall be handled in European jurisdiction.
